These Terms of Service ("Terms") govern your access to and use of Insight's mobile application, website, and related services (collectively, the "Service"). By creating an account or using our Service, you agree to these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. We'll notify you of material changes via email or in-app notification. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

To use Insight, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

Account Creation

You must create an account to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

Account Security

You are responsible for:

• Keeping your password confidential
• Notifying us immediately of any unauthorized access
• All activities that occur under your account

We are not liable for any loss or damage arising from your failure to protect your account credentials.

Free and Paid Services

Insight offers both free and paid subscription tiers. Paid features include:

• Unlimited AI-powered quest generation
• Advanced analytics and insights
• Premium themes and customization
• Priority support

Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Payment is processed through Apple App Store or Google Play Store
• Prices are subject to change with 30 days' notice
• You authorize us to charge your payment method for the subscription fee

Cancellation and Refunds

• You may cancel your subscription at any time through your app store account settings
• Cancellations take effect at the end of the current billing period
• No refunds for partial subscription periods
• Refunds for technical issues handled on a case-by-case basis
• Free trial periods may be offered; you won't be charged if you cancel before the trial ends

You agree to use Insight only for lawful purposes. You will not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload harmful code or viruses
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm other users
• Use the Service for commercial purposes without authorization
• Scrape, data mine, or use automated systems to access the Service
• Reverse engineer or attempt to extract source code
• Impersonate others or misrepresent your affiliation
• Share inappropriate or offensive content

Your Content

You retain ownership of all content you create in Insight (journal entries, quests, notes, etc.). By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Use AI services to generate personalized recommendations
• Create anonymized, aggregated data for analytics

We will not share your personal content publicly or use it for marketing without your explicit consent.

Our Content

All rights, title, and interest in the Service (excluding your content) belong to Insight. This includes:

• Software, code, and algorithms
• Design, graphics, and user interface
• Branding, trademarks, and logos
• Content we create or license

You may not copy, modify, distribute, or create derivative works without our written permission.

Insight uses artificial intelligence to provide personalized recommendations and generate content. You understand and agree that:

• AI-generated suggestions are not professional advice (medical, legal, financial, etc.)
• AI outputs may occasionally be inaccurate or inappropriate
• You use AI features at your own discretion and risk
• We are not responsible for decisions made based on AI recommendations
• You should consult qualified professionals for important decisions

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Insight, you also agree to our Privacy Policy.

Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Professional Advice

Insight is a personal growth tool, not a substitute for professional advice. The Service does not provide medical, psychological, legal, or financial advice. Always consult qualified professionals for important health, legal, or financial decisions.

Service Availability

We strive for high availability but do not guarantee:

• Uninterrupted or error-free operation
• That defects will be corrected
• That the Service is free from viruses or harmful components
• Specific results from using the Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use or inability to use the Service
• Unauthorized access to your data
• Errors, bugs, or interruptions in the Service
• Actions of third-party services we integrate with
• Any other matter relating to the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Insight, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit or share through the Service

By You

You may terminate your account at any time by:

• Deleting your account in the app settings
• Contacting our support team

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Create risk or legal exposure for us

Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your data will be deleted according to our Privacy Policy
• Outstanding payments remain due
• Provisions that should survive termination will remain in effect

Informal Resolution

Before filing a claim, you agree to contact us at contact@getinsight.app to resolve disputes informally. We'll work in good faith to resolve issues within 30 days.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except for small claims court matters or injunctive relief.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action, consolidated, or representative proceeding.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in California.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Insight.

Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right.

Assignment

You may not transfer your rights under these Terms. We may assign our rights to any affiliate or successor.

Updates

We reserve the right to update, modify, or discontinue features at any time with or without notice.
